Terms of Service — Hone Poker

1. Acceptance of these Terms

These Terms of Service (the "Terms") are a binding agreement between you and Hone Poker LLC ("Hone Poker," "we," "us," or "our"). They apply to the honepoker.com website, the Hone Poker application available at hone.poker, and any related content and services (together, the "Service"). By visiting the site, joining the waitlist, creating an account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility — 18 and older

The Service is intended for users who are at least 18 years old (or the age of majority in your place of residence, if higher). By using the Service you represent that you meet this requirement. We do not knowingly permit use of the Service by, or collect personal information from, anyone under 13, and we may suspend or delete any account we reasonably believe belongs to someone under 18.

3. What the Service is — and is not

Hone Poker is a poker training and practice application intended for entertainment and skill-improvement purposes only. You play simulated Texas Hold'em hands against AI opponents and receive feedback on your decisions.

The Service is not gambling. It does not offer real-money gambling, involves no betting or wagering of any kind, and awards no prizes or rewards of real-world value. Nothing in the Service can be exchanged for money or anything of monetary value. Practice or success in Hone Poker does not imply, and should not be relied on as a predictor of, success at real-money poker or gambling of any kind.

4. Accounts

Some features require an account. You agree to provide accurate information when signing up, to keep your login credentials secure, and to notify us if you suspect unauthorized use of your account. You are responsible for activity that occurs under your account. We may suspend or terminate accounts that violate these Terms.

5. Virtual chips have no value

Any chips, points, streaks, ratings, or other virtual items in the Service are play assets with no cash or real-world value. They cannot be sold, transferred, redeemed, or exchanged for money, goods, or services, inside or outside the Service. We may adjust, reset, or remove virtual items at any time as part of operating the Service.

6. License and acceptable use

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial training and entertainment. You agree not to:

use the Service for any unlawful purpose, or in violation of these Terms;
copy, scrape, reverse engineer, or attempt to extract the source code, models, or training logic of the Service, except where such restriction is prohibited by law;
use bots, scripts, or automated means to access the Service, or interfere with or disrupt its operation or security;
resell, sublicense, or commercially exploit the Service or its content without our written permission; or
misrepresent the Service as a gambling product, or use it to facilitate real-money wagering.

7. Intellectual property

The Service — including its software, design, text, graphics, logos, and blog content — is owned by Hone Poker LLC or its licensors and is protected by intellectual-property laws. Except for the limited license above, no rights in the Service are granted to you. "Hone Poker" and associated logos are trademarks of Hone Poker LLC.

8. Feedback

If you send us ideas, suggestions, or other feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use it for any purpose without compensation or obligation to you.

9. No professional advice

Content in the Service and on our blog — including strategy articles and in-game coaching — is for general educational and entertainment purposes only. It is not financial, legal, or professional advice, and it is not an inducement or encouragement to gamble. If you choose to play real-money poker elsewhere, you do so at your own risk and subject to the laws of your jurisdiction.

10. Third-party services

The Service may link to or rely on third-party websites and services we do not control. We are not responsible for their content, policies, or practices, and linking to them does not imply endorsement.

11. Changes to the Service

Hone Poker is under active development. We may add, change, suspend, or discontinue any part of the Service (including free features) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Service.

12. Termination

You may stop using the Service, or delete your account, at any time. We may suspend or terminate your access to the Service at any time, including if we reasonably believe you have violated these Terms or are under 18. Sections that by their nature should survive termination (including Sections 5, 7, 8, and 13–16) survive.

13. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY COACHING, GRADING, OR STRATEGY CONTENT IS ACCURATE, COMPLETE, OR WILL IMPROVE YOUR RESULTS AT POKER.

14. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HONE POKER LLC AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR FIFTY U.S. DOLLARS (US$50). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

15. Indemnification

You agree to indemnify and hold harmless Hone Poker LLC from claims, damages, and expenses (including reasonable attorneys' fees) arising out of your misuse of the Service or your violation of these Terms or of applicable law.

16. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. Any dispute arising out of these Terms or the Service will be brought exclusively in the state or federal courts located in Colorado, and you consent to their jurisdiction. Either party may instead bring a qualifying claim in small-claims court.

17. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms here and update the "Last updated" date above, and where appropriate provide additional notice (for example, by email or in the app). Continuing to use the Service after changes take effect means you accept the updated Terms.

18. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and Hone Poker LLC about the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
